Terms and Conditions of Sale
Article 1 – Seller identity
The LeBaroque.fr website is operated by LEBAROQUE (hereinafter "the Seller").

These General Terms and Conditions of Sale govern sales concluded between the Seller and any individual or legal entity (hereinafter "the Customer") making a purchase on the LeBaroque.fr website.
Article 2 – Purpose
These T&Cs define the rights and obligations of the parties in the context of the online sale of handcrafted creations, decorative objects, and works of art offered on LeBaroque.fr.
Any order implies unreserved acceptance of these T&Cs.
Article 3 – Products
The products offered for sale are those appearing on the site on the day of consultation.
LeBaroque.fr selects in particular:
- Capodimonte ceramics;
- handcrafted Venetian masks;
- Italian-inspired art and decorative objects.
Photographs, descriptions, and characteristics are presented with the greatest care.
However, as the creations are handmade, slight variations in:
- dimensions;
- hues;
- reliefs;
- finishes;
- decorations;
may exist from one piece to another.
These specificities testify to the handcrafted nature of the creations and do not constitute defects.
Article 4 – Availability
Products are offered subject to the availability of partner workshops.
In the event of exceptional unavailability after order validation, the Customer will be informed as soon as possible and may obtain a full refund.
Article 5 – Price
The prices displayed on the site are in euros (€) including all taxes.
Delivery costs are indicated separately during checkout.
The Seller reserves the right to modify its prices at any time.
The applicable price remains the one displayed at the time of order validation.
Article 6 – Order
Any order becomes final after:
- validation of the shopping cart;
- acceptance of these T&Cs;
- confirmation of payment.
A confirmation is sent to the Customer by email.
LeBaroque.fr reserves the right to refuse or cancel any order that appears abnormal or fraudulent.
Article 7 – Payment
Payments are secure and made via:
- Shopify Payments;
- Visa;
- Mastercard;
- American Express;
- Apple Pay;
- PayPal;
- Klarna;
- Bancontact.
The debit occurs upon validation of the order.
LeBaroque.fr never has access to the Customer's banking data.
Article 8 – Craft manufacturing
Certain creations, notably Capodimonte ceramics, are made or prepared to order by Italian partner workshops.
The Customer acknowledges that these creations require specific manufacturing and preparation time before shipment.
Article 9 – Delivery
Orders are shipped by recognized carriers such as:
- DHL;
- FedEx;
- Poste Italiane;
- Laposte;
- or their local partners.

These times are indicative and may vary depending on workshop activity or logistical constraints beyond our control.
Article 10 – Receipt of order
The Customer is invited to check the condition of the package upon delivery.
In case of apparent anomaly:
- damaged package;
- opened package;
- damaged product;
the Customer must formulate precise reservations with the carrier and contact LeBaroque.fr within a maximum period of 48 hours.
Article 11 – Right of withdrawal
In accordance with articles L221-18 and following of the Consumer Code, the Customer has a period of 14 days from receipt of the item to exercise their right of withdrawal.
The request must be sent to:
Return shipping costs remain the responsibility of the Customer.
Products must be returned:
- in their original condition;
- complete;
- with their accessories;
- with any certificates;
- in packaging ensuring protection equivalent to the original packaging.
Article 12 – Refund
The refund is made after receipt and verification of the returned product.
The refund is made via the payment method used when ordering.
Article 13 – Legal guarantees
The Customer benefits from:

under the conditions provided by applicable French legislation.
These guarantees apply independently of any commercial guarantee that may be granted.
Article 14 – Transport-related damages
All shipments benefit from transport insurance adapted to the value of the work shipped.
Any request related to transport damage must be accompanied by:
- reservations made at the time of delivery;
- photographs of the package;
- photographs of the product.
A compensation procedure may then be initiated with the relevant carrier or insurer.
Article 15 – Intellectual property
All content present on LeBaroque.fr remains the exclusive property of the Seller:
- texts;
- photographs;
- logos;
- graphics;
- videos;
- visual elements.
Any reproduction, representation, or use without prior authorization is prohibited. Any offender is liable to potential legal action.
Article 16 – Personal data
The collected data is processed in accordance with the applicable regulations on personal data protection.
The Customer has in particular:
- a right of access;
- a right of rectification;
- a right of erasure;
- a right of opposition.

Article 17 – Force majeure
LeBaroque.fr cannot be held responsible for a delay or failure resulting from an event of force majeure within the meaning of French case law.
Article 18 – Mediation
In the event of a dispute, the Customer is invited to contact customer service as a priority to seek an amicable solution.
In the absence of an agreement, the consumer Customer may use a consumer mediator free of charge in accordance with the provisions of the Consumer Code.
Article 19 – Applicable law
These General Terms and Conditions of Sale are subject to French law.
Any dispute relating to their interpretation or execution will be submitted to the competent courts in accordance with the rules of French law.
